Charges now 'upped' for both men allegedly involed in the death of teen New Year's Eve

A teenage girl's death on New Year's Eve leads police to 'up' the charges against two men involved in the case.

The death of 13-year-old Sophia Martinez, after a night of drinking with a friend and two grown men, has prompted police to pursue more charges beyond endangerment of a child. Austin Police Sergeant Brian Miller says lab tests have revealed evidence of a sexual encounter, "We didn't get the permission to go ahead with the charges until about four days afterwards and the DA's office was finally satisfied with the investigation."

That's 'after' the two men were allowed to leave police custody.  One of the men, Jose Garcia, violated his parole by not showing up to a meeting the next day.  23-year-old Mario Hernandez is also charged.
