Freed man files complaint against ex-TX prosecutor

1/21/2014

HOUSTON (AP) - A former Texas death row inmate exonerated in the 1992 killing of six people in Burleson County has filed another complaint against an ex-prosecutor.

Anthony Graves on Monday filed a grievance with the State Bar of Texas alleging then-District Attorney Charles Sebesta suppressed evidence.

Sebesta on Monday said he still believes Graves is guilty.

Graves spent 18 years behind bars.

An appeals court in 2006 overturned his conviction but Graves was held for possible retrial. Graves in 2007 filed a similar grievance against Sebesta, which was reviewed and dismissed.

Graves was freed in 2010, with DNA evidence, when a special prosecutor determined he wasn't involved in the killings.

A new Texas law allows a grievance against a prosecutor to be filed within four years of a wrongfully imprisoned person's release.
