Senators move to repeal anti-gay law


AUSTIN, Texas (AP) - A Texas Senate Committee has voted to repeal an anti-gay law overturned by the U.S. Supreme Court in 2003.

The chairman of the Senate Criminal Justice Committee said Wednesday it was time to take the sodomy law off the books. The committee approved the repeal 5-0 vote and sent it to the full Senate.

El Paso Sen. Jose Rodriguez authored the bill. In 2009, he said El Paso police arrested a same-sex couple for kissing not realizing the law was no longer valid, resulting in a lawsuit.

The Legislature outlawed homosexual activity in 1973. A Houston man charged with sodomy appealed to the Supreme Court where it was declared that the law unconstitutional.

Democrats have also proposed a new law that would make discriminating against gays for employment illegal.
