Legislators question Perry’s use of law to pay for Guard

Lawmakers on Tuesday questioned Gov. Rick Perry’s unilateral declaration of an emergency along the border so that he could shift $38.7 million from the state budget to pay for the National Guard.

When the Legislature is not in session, large budget transfers require approval of key House and Senate leaders who make up the Legislative Budget Board. But Perry invoked a never-before-used 1993 law granting him extraordinary powers during an emergency.

Rep. Sylvester Turner, D-Houston, a board member, said he fears Perry has set a bad precedent, declaring emergencies and bypassing legislators tasked with making such budget decisions.
