Texas AG's office vows to fight Confederate flag license plate ruling

The state attorney general’s office moved swiftly Tuesday, vowing to challenge a court ruling that’s expected to force Texas to issue license plates decorated with the Confederate battle flag.

A federal appeals panel ruled 2-1 Monday that the Department of Motor Vehicles had violated the Sons of Confederate Veterans’ free speech rights and engaged in “viewpoint discrimination” when it rejected the group’s specialty plate request in 2011.

The state has two options: request a rehearing before the full 5th U.S. Circuit Court of Appeals in New Orleans, or take it to the Supreme Court.
