Gun was legally purchased, lawyer said

There have been numerous questions as to why Texas cornerback Tarell Brown had a 9 mm handgun on his lap while traveling in a car with teammate Tyrell Gatewood and former Longhorn Aaron Harris.

According to the lawyer of both Gatewood and Brown, Gatewood purchased the gun from a licensed store and had filed out paperwork when he bought it.

Jamie Balagia, the lawyer, said: “A couple of weeks ago he went target shooting at an indoor range and placed the gun under the drivers seat in his car when he finished. He then forgot all about it and failed to secure the gun when he got home later.

Details Emerge on Longhorns' Arrest

Austin lawyer Jamie Balagia is representing both Tarell Brown and Tyrell Gatewood, the Longhorn football players who were arrested early Monday with ex-Texas player Aaron Harris on drugs and weapons charges.

He told the American-Statesman Monday that both his clients were drug tested — at their request — to prove that the marijuana that led to their arrest was not theirs.

“All in all, it was a weird set of circumstances,” Balagia said. “When the facts come out, this will be resolved pretty quickly.”

According to the arrest affidavit, Brown was arrested after deputies pulled over Harris in a traffic stop on Interstate 35 North just before 3 a.m. Brown was asleep in the back seat. Deputies saw a gun in his lap, and banged on the windows of the car to wake him. Balagia said the weapon was a “recreational gun” Gatewood had purchased two weeks ago for target practice. The report said it was a loaded 9 mm handgun. Balagia said that Brown had found the gun on the floorboard of the backseat and picked it up.

BREAKING NEWS: UT Football Players Arrested

A University of Texas football player and a former Longhorn starter are jailed early today. Starting cornerback Tarell Brown is free on a personal bond, after being arrested before five this morning on misdemeanor weapons and marijuana charges. Aaron Harris, a one-time starting linebacker for the 'Horns, remains in the Travis County Jail on a misdemeanor pot charge.

Longhorn starting cornerback Tarell Brown was arrested early today on marijuana and weapon charges.

Brown and former teammate Aaron Harris, a linebacker on last year’s national championship team, were booked into Travis County Central Booking Facility at 4:55 a.m. Monday.

Brown was charged with a Class A misdemeanor of unlawfully carrying a weapon. He and Harris were both charged with Class B misdemeanors of possession of 2 ounces or less of marijuana.

Longhorn football coach Mack Brown has been informed of the situation but has not yet spoken to Brown, a team official said.
