Texas Court rules against Austin’s Paid Sick Leave Ordinance

Judge's Gavel

Texas’ 3rd Court of Appeals ruled that Austin’s forced sick pay mandate is preempted by the Texas Minimum Wage Act, and thus it is violation of the Texas Constitution.  The ordinance was challenged by both the Texas Association of Business and the National Federation of Independent Business asking that the ordinance be blocked.  The Friday (Nov. 16th) ruling means the case will be sent back down to a district court, where a judge there will be ordered to allow an injunction to be issued, which was requested by both the TAB and the NFIB
