The fight over citywide bag bans continues at the Texas Supreme Court.
No ruling has been made yet over a suit filed by a group of Laredo business owners who say these bans are illegal. Citing Section 361 of the Texas Health and Safety Code, Brian Matthew with the Texas Public Policy Foundation says local bans are not legal because they prevent the sale and/or use of something which can be alternatively used for waste management purposes.
Austin’s bag ban has been in place since 2013 but a ruling in favor of these business owners could mean the city council would have to give the power back to businesses to decide.
