Austin City Council Considers Buffers Zone for Schools and Vape Shops

The Austin City Council is considering new zoning restrictions that would limit where businesses selling vape and e-cigarette products can operate—particularly in close proximity to schools.

City leaders say the proposal is aimed at reducing youth access to nicotine products, as concerns continue to grow over vaping among middle and high school students.

Under the proposal, new vape retailers would be prohibited from opening within  1000 feet of schools. However, as proposed, large grocery stores or stores that currently exist within that 1000 foot buffer would be excluded.

Supporters say similar zoning rules already exist for other types of businesses, such as bars and liquor stores, and argue that vape shops should be treated with the same level of scrutiny.

Backers of the proposal—including some public health advocates and parents—say the move is about protecting kids.

They point to studies showing a rise in youth vaping and argue that easy access near schools only makes the problem worse. By creating distance between vape retailers and campuses, supporters believe the city can reduce impulse purchases and limit exposure.

Some also argue that flavored products and targeted marketing have made vaping especially appealing to younger users.

However, not everyone is on board.

Vape shop owners and industry advocates say the proposed restrictions unfairly single out their businesses and could hurt small, locally owned shops. They argue that existing laws already prohibit sales to minors and that responsible retailers follow those rules.

Critics also question whether zoning restrictions will actually reduce youth vaping, suggesting that online sales and social sources play a larger role than storefront access.

If approved, the new zoning rules would mark another step in the city’s ongoing efforts to address public health concerns tied to vaping—while also raising new questions about economic impact and regulatory fairness.
