A Texas Judge says Academy can be sued for selling to the Sutherland Springs Church Shooter.
The lawyer for the victim’s families Jason Webster said a Texas Academy should have denied the sale of weapons to the shooter when he used a Colorado ID as part of the background check. Legally, Webster claimed Academy and any business selling firearms have to follow the letter of the law of the buyer’s home state. In This case, the shooter bought high capacity magazines, which while legal in Texas are illegal in Colorado.
Webster added if Academy sold weapons and magazines to the shooter in compliance with Colorado law, he wouldn’t be suing.
Webster said there are several other cases just like this that have gone to trial, and expects to see Academy’s lawyers in court in November of 2019.
