Judge to Hear I-35 Expansion Lawsuit

After a lawsuit was filed against the Texas Department of Transportation back in January 2024 over the planned I-35 Capital Express Central Project, a judge is set to hear the case Wednesday September 10th.

The lawsuit, filed by the activist group Rethink35, argues that TxDOT failed to adequately study the possible air pollution — especially fine-particulate matter (PM2.5), a harmful pollutant associated with serious respiratory and heart conditions — and health impacts of expanding I-35.

The full legal complaint can be read HERE.

“We’ve deeply appreciated the incredible broad community support for the lawsuit,” says Rethink35 board member Miriam Schoenfield. “To see people united for cleaner air and a better outcome than TxDOT’s harmful and wasteful highway expansion has been incredible. We’re hopeful the judge will truly hear the merits of our case.”

Wednesday’s hearing could mark the case’s conclusion, since the court will hear cross-motions for summary judgment by both Rethink35 et al and TxDOT. However, the verdict may not be announced until a later date.
